Terms of Service

Welcome to 1Bio.lat (the "Site", "Platform", "Service"). The Site is an adult dating and lifestyle platform operated by 1Bio.lat ("1Bio", "we", "us", "our"), Rua Senador Dantas 117, 20031-204 Rio de Janeiro, Brazil. These Terms of Service, together with our Privacy Policy, form a binding agreement ("Agreement") between you and 1Bio that governs your access to and use of the Site, whether or not you create an account.

By accessing, browsing, or using the Site in any way, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, you must not use the Site. We may revise this Agreement from time to time; the current version is always posted here, and your continued use after changes take effect means you accept the revised terms. Please check this page periodically.

1. Adult content & age confirmation

The Site contains sexually explicit words, images, video, and links intended for adults. Access is granted only to individuals who confirm each of the following:

• I am at least 18 years old (or the age of majority in my jurisdiction, whichever is higher), and I will not permit any minor to access the Site.
• Adult, sexually explicit material is lawful to view in my community and location.
• I choose to receive such material and am not offended by it.
• I accept sole responsibility for my own actions and release 1Bio from any liability arising from my access.

By clicking "I agree", entering the Site, or otherwise using it, you affirm all of the above under your electronic signature.

2. No illegal services

1Bio does not facilitate, promote, or endorse prostitution or any other unlawful activity. Where the Site allows professional listings (for example escort, massage, stripper, creator, or venue profiles), any fee a professional may charge is for their time, companionship, or lawful services only. 1Bio charges its users solely for access to features of the Platform and never takes any share of, or payment for, companionship arranged between users. Content that solicits, suggests, or implies an unlawful exchange of money for sexual activity is strictly prohibited.

3. Eligibility & electronic acceptance

You must be 18 or older to register or otherwise use the Site, and use is void where prohibited by law. By using the Site you represent that you have the right, authority, and capacity to enter into this Agreement and to comply with it. Acceptance does not require a handwritten signature: clicking "I agree", or taking any action that demonstrates your assent, has the same legal effect as a physical signature. If you use any commercial or advertiser feature, that use further confirms your unconditional acceptance of this Agreement.

4. Accounts, profiles & security

Your account is personal to you. During registration you must provide true, accurate, current, and complete information, and keep it up to date. You are responsible for choosing a secure password, keeping your credentials confidential, and for all activity that occurs under your account. Do not share your password or use anyone else's account. Notify us immediately of any unauthorized use or security breach, and log out at the end of each session. We are not liable for any loss resulting from your failure to meet these obligations.

On 1Bio, an account may hold one or more profiles of different types (for example private/dating, fetish, or professional listings). Actions on the Site are carried out by an active profile; the underlying account is an internal container only.

5. Membership, Premium, Wallet & fees

A standard (Basic) account is free but does not include every feature. Additional features may require a paid Premium upgrade, offered per profile in fixed-term increments and payable in advance. Where the Site provides a Wallet, balances are denominated in EUR; payments made in another currency are converted at the rate in effect at the time, and the credited balance is always in EUR.

You agree to pay all fees and applicable taxes at the rates in effect when a charge is incurred, in the currency determined by your location at the time of payment. Except where required by law (see section 6), all fees and charges are non-refundable, including if you cancel early or if we terminate your access for breach of this Agreement. We may change fees, or add new fees, by posting them on the Site. You are responsible for any third-party costs (such as internet access) you incur, and for any amounts billed to your payment method by a third party that you did not authorize. The Service may include service announcements and administrative messages that form part of the Service and that you cannot opt out of, and it may display advertisements.

6. EU consumers — right of withdrawal

If you are a consumer in the European Union, you normally have 14 days to withdraw from a distance contract. However, for digital content and services that begin immediately at your request, the right of withdrawal is lost once performance has started. By purchasing a Premium upgrade or adding Wallet credit and choosing immediate activation, you expressly consent to immediate performance and acknowledge that you thereby waive your 14-day right of withdrawal for that purchase. Where the right still applies, you may exercise it by contacting legal@1bio.lat.

7. Identity & age verification; records

We may require identity and age verification (KYC) before enabling certain features. You agree to provide accurate verification data and confirm that you have the lawful right to submit it. You are solely responsible for maintaining any records required by the laws of your jurisdiction in connection with content you publish, including records evidencing that every depicted person was at least 18 at the time of creation. The Site acts only as a hosting forum for user content.

8. User content & licence

"User Content" means any text, image, video, audio, communication, or other material you publish, transmit, or otherwise make available through the Site. You retain ownership of your User Content. By submitting it, and except for personal data (which is governed by our Privacy Policy), you grant 1Bio a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable licence to host, store, reproduce, adapt, translate, publish, publicly display and perform, distribute, and create derivative works from that User Content, in any medium now known or later developed, for the purpose of operating, providing, and promoting the Site and related services.

You represent and warrant that you own or otherwise control all rights in your User Content and have the authority to grant this licence, and that the content does not infringe the rights of any third party. You will not be compensated for User Content. Because some uses are ongoing, content may remain in backups or already-distributed materials for a reasonable period after you delete it or close your account, and aggregated or compiled databases incorporating it may persist. We do not pre-screen all content but may review, refuse, or remove any content at our discretion to enforce this Agreement or comply with law. In the event of a merger, sale, or transfer of our assets, User Content and related account data may be transferred to the successor entity.

9. Prohibited content

You must not upload, publish, or transmit content that:

• depicts, or appears to depict, any person under 18, or implies that a depicted person is a minor;
• is defamatory, obscene beyond what the Platform permits, harassing, hateful, threatening, or otherwise unlawful;
• solicits or implies an unlawful exchange of money for sexual activity, or references illegal drugs, violence, or other criminal activity through text, code, slang, or acronyms;
• misrepresents your identity, or is a fake or inaccurate depiction of you;
• was created or is used without the authorization of its rightful owner, or infringes any intellectual-property or publicity right;
• discloses another user's private contact or personal information, or your own contact details outside the formats the Site permits;
• disparages the Site or promotes a competing service;
• contains viruses or other harmful code.

We may remove any such content and suspend or close offending accounts. We encourage users to report violations.

10. Acceptable use

You agree that you will not:

• cause or risk harm to minors, or threaten harm to any person or property;
• harass, degrade, or intimidate anyone on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
• send unsolicited advertising, spam, chain letters, or bulk messages;
• impersonate any person or misrepresent your affiliation;
• forge headers or manipulate identifiers to disguise the origin of content;
• infringe any patent, trademark, trade secret, copyright, or other proprietary right;
• reverse engineer, decompile, or attempt to access the Site's source code;
• access the Site other than through the interface we provide, or attempt unauthorized access to another account or to our systems;
• impose an unreasonable load on, or otherwise harm, our servers or network;
• engage in commercial activity or solicitation without our prior written consent, except as expressly permitted for professional listings.

11. Proprietary rights, trademarks & copyright

1Bio and its licensors own all rights in the Site, including its software, design, trademarks, service marks, and other proprietary material. We grant you a limited, non-exclusive, non-transferable right to access and use the Site for your personal use, provided you comply with this Agreement. Except for content that is in the public domain or for which you have written permission, you may not copy, modify, publish, transmit, distribute, perform, display, sell, reverse engineer, or create derivative works from any part of the Site or its underlying technology.

12. Copyright infringement notice

If you believe content on the Site infringes your copyright, please email dmca@1bio.lat with: your name, address, telephone number, and email; a description of the copyrighted work; the exact location (URL) of the allegedly infringing material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on their behalf; and your physical or electronic signature.

13. Third-party links

The Site may link to third-party websites that we do not control and are not responsible for. Such links are provided for convenience only and do not imply endorsement. You access linked sites at your own risk.

14. Reservation of rights & termination

This Agreement remains in effect while you use the Site. You may close your account at any time via your account settings or by emailing us. We may, at our sole discretion and without notice, restrict, suspend, or terminate your access to all or part of the Site; refuse, move, or remove content; deactivate or delete accounts and related data; and set general usage limits. If we terminate your access for breach, you are not entitled to a refund of unused fees. We will not be liable to you or any third party for any such action.

15. Assumption of risk

You use the Site at your own risk. 1Bio is not responsible for the conduct of any user, online or offline, and is not a party to, and assumes no liability for, any meeting, encounter, or transaction that arises from your use of the Site. Use common sense and take appropriate precautions when interacting with other users.

16. Disclaimer of warranties

The Site and all materials are provided "as is", "with all faults", and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that defects will be corrected. You assume the entire cost of any necessary servicing or repair. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, 1Bio and its partners will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of, or inability to use, the Site, even if advised of the possibility. Our total liability for all claims relating to the Site or this Agreement will not exceed the amount you paid us, if any, for accessing the Site. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

18. Indemnification

You agree to indemnify, defend, and hold harmless 1Bio and its affiliates, officers, directors, employees, and agents from any third-party claims, losses, liabilities, damages, and costs (including reasonable legal fees) arising from your use of the Site, your violation of this Agreement, or your infringement of any right of any person or entity.

19. Reporting abuse

1Bio operates an interactive service that lets people communicate with one another. We do not tolerate abuse, harassment, or misuse of the Site, and users who engage in such conduct risk termination and possible civil or criminal liability. Please report any misconduct to support@1bio.lat.

20. Governing law & jurisdiction

This Agreement is governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to this Agreement or the Site will be brought exclusively before the competent courts of Rio de Janeiro, Brazil, and you consent to their jurisdiction. Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

21. Force majeure

We are not responsible for any failure or delay in performing our obligations caused by events beyond our reasonable control, including acts of God, natural disasters, fire, war, civil unrest, network or hosting failures, and power outages.

22. Notices

We may provide notices to you by posting them on the Site or sending them to the email address associated with your account; such notices are effective when posted or sent. Keep your contact details accurate so that we can reach you. You may update your email in your account settings.

23. Severability, entire agreement & waiver

If any provision of this Agreement is held unenforceable, the remaining provisions stay in full force and effect. This Agreement, together with the Privacy Policy, is the entire agreement between you and 1Bio regarding the Site and supersedes any prior understanding. No modification or waiver is effective unless posted on the Site, and our failure to enforce any right is not a waiver of that or any other right.
